Introduction

Instant Payment System: The Instant Payment System is a real-time payment solution in Libya, providing an innovative digital platform for financial transactions. It enables instant sending and receiving of funds between bank accounts across all participating banks operating in Libya. The system is developed by Muamalat Financial Services Company, a Libyan joint-stock company headquartered in Tripoli. This system is part of the National Payment System Network (NPS – “Nomo”), owned by the Central Bank of Libya, and falls under its FinTech program, managed by Muamalat Financial Services Company. Muamalat operates the instant payment network under the authorization of the Central Bank of Libya. This service adheres to the rules and regulations issued by the Central Bank. The Instant Payment System consists of the IPS Gateway, the National Alias Directory (NAD), and the NPS network. The system connects to banks through Application Programming Interfaces (APIs), executes debit and credit transactions via the NPS network, and performs settlement through the RTGS system. Banks are responsible for providing payment channels to their customers and merchants by integrating with the Instant Payment System and the NPS network.

User Registration and Account Security

Required Conditions for User Registration in the National Alias Directory Registering user data in the National Alias Directory is an essential requirement to use the Instant Payment System. The following conditions must be met:
  • The user must be a Libyan citizen holding a valid national ID number.
  • The user must have a mobile phone number issued by one of the Libyan telecommunications companies.
  • The phone number must be registered under the user’s name and linked to their national ID number.

Guidelines to Maintain the Security and Confidentiality of User Accounts

To ensure the security of your account in the Instant Payment System, we recommend following these guidelines:

  • Use a strong and unique password for your account on banking channels connected to the system.
  • Do not share your personal account information with others.
  • Ensure the confidentiality of your national ID and phone number data.
  • If linking to a bank account, make sure that the associated data such as the national ID and phone number match the information provided during the registration process on banking channels.

Data Verification

  • Accurate verification of the data submitted during registration is an integral part of the process to ensure account security and data accuracy.
  • Users may be required to provide additional documents or undergo further verification steps to confirm the validity of the data.

User Data Protection

  • Security: We take all reasonable measures to protect user data from unauthorized access, disclosure, alteration, and destruction. We use advanced encryption technologies and security protocols to safeguard data transmitted through the system.
  • Storage and Processing: Data is stored on secure servers and processed in a manner that respects users’ privacy.

Compliance with Data Protection Laws

  • Legal Compliance: We comply with all local and international laws and regulations related to data protection in Libya. We regularly update our policies to ensure adherence to the latest legal requirements.
  • User Rights: We respect users’ rights to access and correct their data. Users may contact us at any time to exercise these rights.

User Behavior and Responsibilities in the Instant Payment System

Acceptable and Prohibited Uses of the System

  • Acceptable Uses:
    • Using the system to conduct personal financial transactions through connected banking channels according to its intended purpose.
    • Complying with the instructions and guidelines provided to ensure a safe and efficient financial process.
    • Verifying the accuracy and correctness of the data submitted when performing transactions.
  • Prohibited Uses:
    • Using the system for any illegal purposes, such as money laundering, terrorism financing, or any other prohibited activities.
    • Using the system in any operations involving fraud or deception.
    • Sharing the account with others or allowing them to use it is strictly prohibited.

User Responsibilities Regarding Accurate Information Submission and Legal Compliance

  • Providing Accurate Information: Users bear full responsibility for the accuracy and correctness of the data they submit during registration and transactions.
  • Updating Personal Data: Personal data must be updated in case of any changes to ensure uninterrupted service continuity.
  • Legal Compliance:
    • Users must comply with all local laws and regulations related to financial transactions in Libya.
    • In case of detecting any suspicious or illegal activity, the system operator has the right to investigate and take appropriate actions, including service termination.

Financial Transactions

Transaction Execution Terms

  • Limits: The system sets specific limits for transactions, whether daily or monthly, to ensure security and compliance with financial regulations. Users can view these limits within the banking channels connected to the system.
  • Fees: Certain fees may apply to some transactions, and these fees are clearly explained before completing any transaction.
  • Processing Times: Transaction processing times vary depending on the type of operation and the involved banks. The system strives to execute transactions as quickly as possible, but delays may occur due to factors beyond our control.

Liability for Unauthorized Transactions or Errors

  • Reporting Unauthorized Transactions: If any unauthorized transactions or suspected fraud are detected, users must immediately report them through the banking channels connected to the system or by contacting customer service.
  • Investigation and Compensation: Any reports related to suspicious transactions will be investigated. If a transaction is identified as unauthorized due to a system error or security breach, every effort will be made to rectify the situation and compensate users according to applicable policies.
  • User Obligations: Users must ensure the accuracy of the information provided when conducting transactions to avoid errors. Users should also refrain from sharing their personal and account data with any third parties to prevent unauthorized transactions and fraud.

Intellectual Property Rights

  • Content Ownership: The Instant Payment System contains materials and content, including texts, graphics, logos, icons, images, videos, and APIs, which are the exclusive property of Muamlat Financial Services Company or its licensors. All rights reserved.
  • Trademarks: The trademarks, logos, and service names displayed in the system are trademarks owned by Muamlat Financial Services Company or the respective third parties. These marks may not be used in any form without prior written consent from their owners.
  • Intellectual Property: Copying, modifying, republishing, uploading, transmitting, distributing, or exploiting any part of the system for commercial or public purposes is prohibited without prior written permission from Muamlat Financial Services Company.

Authorized Use: Use of the content and information available in the system is permitted for personal, non-commercial purposes in accordance with the stated terms and conditions.

Disclaimer and Limitation of Liability

Disclaimers Regarding System Functions and Services

  • Performance and Availability: Muamlat Financial Services Company makes every reasonable effort to ensure reliable performance and continuous availability of the system services. However, we acknowledge that the system may experience unexpected outages or technical malfunctions beyond our control.
  • Updates and Changes: The system may undergo periodic updates aimed at improving performance and adding new features. We do not guarantee that these updates will not temporarily affect the use of the system.

Limitation of System Liability in Force Majeure Circumstances

  • System Liability: Muamlat Financial Services Company shall not be held liable for any direct, indirect, incidental, or special losses arising from the use or inability to use the system.
  • Financial Transactions: In case of errors in transactions resulting from user mistakes or failure to provide accurate information, Muamlat Financial Services Company is not responsible for any consequences arising from such errors.
  • Circumstances Beyond Control: Muamlat Financial Services Company shall not be responsible for any delays or interruptions in service performance or data loss if such delays or interruptions result from circumstances beyond its control, including but not limited to natural disasters and major technical failures.

Modifications and Termination

How to Update or Amend the Terms

  • Notice of Changes: Muamlat Financial Services Company reserves the right to modify or update the terms and conditions of the system at any time. Users will be notified of any changes through announcements on the banking channels connected to the system or via the user’s email.
  • User Responsibility: Users are responsible for reviewing the updated terms and conditions. Continued use of the system after any changes constitutes implicit acceptance of the new terms.

Cases in Which User Accounts May Be Suspended

  • Violation of Terms: If a user violates any of the stated terms and conditions, Muamlat Financial Services Company has the right to take appropriate actions, including terminating or suspending the user’s account.
  • Suspicious Activity: If illegal or suspicious activity is detected related to a user account, Muamlat Financial Services Company reserves the right to immediately terminate the account.

Jurisdiction, Governing Law, and Dispute Resolution

These terms and conditions are governed by and interpreted in accordance with Libyan law. Any dispute or disagreement of any kind arising in connection with these terms and conditions should be resolved amicably between the parties. If amicable solutions cannot be reached, the dispute shall be settled before the Libyan courts.
